About these terms
These terms are an agreement between you and William March, trading as Meshsmith ("Meshsmith", "we", "us"). Meshsmith is a trading name of William March, a sole trader based in the UK. Business address: 4a Victoria Grove, Bridport, DT6 5AW. Email: info@finterm.xyz.
These terms apply when you use meshsmith.xyz and the Meshsmith service, with or without an account. Please read them together with our Privacy Policy, Cookie Policy and Refund and Cancellation Policy.
Consumers and businesses. You are a consumer if you use Meshsmith mainly for purposes outside your trade, business, craft or profession. Some sections apply differently to consumers and businesses, and we say where. Nothing in these terms affects your legal rights as a consumer.
The service
Meshsmith is an AI 3D model generator. You type a text prompt or upload a photo, and the service generates a 3D model that you can download as a GLB file.
- Draft generations are free and untextured.
- Standard, High and Ultra generations are textured and use credits.
- How long a generation takes depends on the quality you choose and on demand. The times on our pricing page are typical, not guaranteed.
- Results are produced by AI models and vary from one run to the next. A model may not match your prompt or photo exactly, and some results have flaws, such as broken or lumpy shapes. Check each model before you rely on it, especially before 3D printing or using it commercially.
We may change, improve or remove features. If a change significantly reduces what you get from a paid plan, we will tell you before it happens. You can then cancel. If you are a consumer, we will refund any amount you have paid for the period after the change.
Accounts
- You can use the free tier without an account. You can also create an account with an email address and password, or sign in with GitHub, Google or X. If you sign up with an email address, we send a verification code to it.
- You must be 18 or over to create an account or buy a plan.
- Give accurate details, keep your password secure and do not share your account. If you think someone else has used your account, tell us at info@finterm.xyz.
- You are responsible for what happens on your account, unless it happened because we failed to keep the service secure.
- To delete your account, email info@finterm.xyz from the address on your account. We delete the account and its models within 30 days.
Free tier
- Without an account, you can make 3 untextured drafts a day.
- With a free account, you can make 5 untextured drafts a day.
- We use your IP address and your account to apply these limits. Do not try to get around them, for example by creating several accounts.
- Free drafts are for personal, non-commercial use and for testing prompts.
Paid plans, credits and payment
Plans and prices
- Pro: £29 a month for 500 credits each billing month.
- Studio: £79 a month for 1,500 credits each billing month.
Prices are in pounds sterling. No VAT is charged, because Meshsmith is not VAT-registered. The price that applies to you is the one shown when you check out.
Credits
- Each textured generation uses credits: Standard 10, High 15, Ultra 30. The cost is shown before you press Generate.
- Your plan's credits are added at the start of each billing month.
- Unused credits do not roll over. At each renewal, your balance is reset to your plan's allowance.
- Credits have no cash value. They cannot be transferred, sold or exchanged for money, except where our Refund and Cancellation Policy or the law gives you a refund.
- If a generation fails, the credits it used go back into your balance automatically.
Payment
Stripe takes payment on its secure checkout page. We do not see or store your full card details. When you subscribe, you authorise us, through Stripe, to charge your payment method at the start of each billing month until you cancel.
Automatic renewal
Paid plans are monthly subscriptions that renew automatically. On your renewal date each month, we charge your payment method the plan price and reset your credit balance to your plan's allowance. This continues until you cancel.
Changing plan
- An upgrade from Pro to Studio takes effect straight away. We charge you the difference for the current month and top up your credit balance to the Studio allowance.
- A downgrade from Studio to Pro takes effect at your next renewal. You keep your current credits until then, and you pay the Pro price from that renewal.
- To go back to Free, cancel your subscription.
Price changes
We may change plan prices. We will email you at least 30 days before a new price applies to your subscription, and you can cancel before it takes effect.
Failed payments
If a renewal payment fails, Stripe may try again. If we cannot collect payment, we may move your account to the Free plan. You keep access to the models you have already generated.
Cancelling your subscription
- You can cancel at any time under Manage billing in your account, which opens the Stripe customer portal. You can also email info@finterm.xyz and we will cancel for you.
- When you cancel, we do not charge you again. Your plan and remaining credits stay active until the end of the billing month you have paid for. After that, your account moves to the Free plan.
- Cancelling does not delete your account or your models.
Refunds and your right to cancel
Our Refund and Cancellation Policy explains when you can get a refund, including your 14-day right to cancel as a consumer and when that right ends. In summary:
- If you are a consumer and you cancel within 14 days of first subscribing, before using any paid credits, you get a full refund.
- When you subscribe, you ask us to start supplying the service immediately and confirm that you understand you lose the 14-day right to cancel once you use paid credits.
- Credits for failed generations are refunded automatically.
- Your rights under the Consumer Rights Act 2015 are not affected. If the service or a model you paid for is faulty or not as described, you are entitled to a repair or replacement, or in some cases a price reduction or refund.
Acceptable use
You must not use Meshsmith, or any model, image or other result from it ("Outputs"):
- in a way that breaks any law or regulation, or infringes anyone's rights;
- to exploit, harm or attempt to harm children, or to create sexual content involving minors;
- to create sexually explicit content, or content showing a real person without their permission;
- to defame, disparage, harass or threaten anyone;
- to create or spread false information meant to deceive or harm others, or to pass off Outputs as not AI-generated where the law or the context requires you to say they are;
- to impersonate a person or organisation;
- to generate or spread personal information that could be used to harm someone;
- to discriminate against or harm people or groups based on protected characteristics or social behaviour, or to exploit vulnerable people;
- for fully automated decisions that affect a person's legal rights or create similar binding obligations;
- to give medical advice or interpret medical results;
- to predict crime, or to profile people for law enforcement or immigration purposes;
- to promote violent extremism or terrorism, or for military purposes;
- to make weapons, or parts of weapons, that are illegal where you are;
- to upload prompts or photos you do not have the right to use, including photos of other people without their permission, or other people's copyrighted designs, characters or trade marks;
- to try to get around usage limits, credit charges or security measures, to scrape the service, or to send automated requests other than through features we provide;
- to upload malware, or to interfere with or overload the service.
Points 1 to 11 include use restrictions that the licences of the AI models we use require us to pass on to you. These restrictions also apply to anyone you give Outputs to, and you must pass them on to that person.
We may refuse a prompt or upload, remove content, or suspend or close an account that breaks this section.
Your content, your models and licences
What you upload
You keep ownership of the prompts and photos you upload ("Inputs"). You give us a non-exclusive, worldwide, royalty-free licence to store, copy and process your Inputs only as far as we need to run the service for you, keep it secure and meet our legal obligations. This licence ends when your Inputs are deleted.
We do not use your Inputs or Outputs to train AI models.
You promise that you have the right to upload your Inputs, and that our use of them to run the service will not infringe anyone's rights.
Who owns the models you generate
As between you and us, you own the Outputs you generate, and we transfer to you any rights we may have in them. This is subject to:
- the licences of the underlying AI models listed below;
- the rights of anyone else in material you used as an Input, for example a photo of someone else's product or artwork; and
- the rest of this section.
Please note:
- AI-generated models may not be protected by copyright, or the protection may be limited. We do not promise that you can stop other people from using similar models.
- Other users may generate models that are similar or identical to yours. We cannot give you exclusive rights over similar results.
- We do not check whether an Output infringes anyone else's rights. You are responsible for how you use Outputs, especially commercially.
Commercial use
- Pro and Studio: you may use Outputs you generate while on a paid plan for commercial purposes, including in games, products, client work and items you sell. This is subject to the Acceptable use section, the section above and the model licences below.
- Free: free drafts are for personal, non-commercial use and for testing only.
Underlying model licences
Meshsmith uses these AI models:
- Microsoft TRELLIS generates 3D models. It is licensed under the MIT License, Copyright (c) Microsoft Corporation.
- Tencent Hunyuan3D-2.0 generates 3D models and their textures. It is licensed under the Tencent Hunyuan 3D 2.0 Community License Agreement, which includes an acceptable use policy and a ban on using its outputs to improve other AI models. These restrictions also apply to you.
- RealVisXL V5.0, which is based on Stable Diffusion XL, generates concept images. It is licensed under the CreativeML Open RAIL++-M License.
The CreativeML Open RAIL++-M License requires the use restrictions in points 1 to 11 of the Acceptable use section to apply to you and to anyone you pass Outputs to. The licensors of these models claim no rights in the Outputs you generate.
Your licence to use Meshsmith
We give you a personal, non-transferable, non-exclusive right to use the Meshsmith website and service in line with these terms. All rights in the Meshsmith service, software, design and brand belong to us or our licensors.
Copyright and takedown
If you think content on Meshsmith infringes your copyright, trade mark or other rights, email info@finterm.xyz with:
- your name and contact details;
- what you own, and where it appears on Meshsmith (a link or a description);
- why you believe it infringes your rights; and
- a statement that the information in your notice is accurate and that you are the rights holder or are authorised to act for them.
We will review your notice promptly and may remove or disable access to the content. Where appropriate, we will tell the user and give them a chance to respond. We close the accounts of people who repeatedly infringe others' rights.
Availability
We aim to keep Meshsmith available, but we do not promise that it will always be available or free of errors. Generation runs on third-party GPU servers and can be delayed by demand or while servers start up. We may suspend the service for maintenance or for security reasons. If a paid plan is unavailable for a long time through our fault, contact us and we will put it right, for example with credits or a partial refund.
Our liability
If you are a consumer
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if we both knew it might happen when you accepted these terms.
- We are not responsible for loss that is not foreseeable. If you use Meshsmith for a trade, business or profession, for example commercial use on a paid plan, the business section below applies to that use instead.
- If digital content we supply damages a device or other digital content that belongs to you, because we failed to use reasonable care and skill, we will repair the damage or pay you compensation.
If you are a business
- We exclude all implied terms, conditions and warranties as far as the law allows.
- We are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
- Our total liability to you in any 12-month period is limited to the amount you paid us in that period, or £100, whichever is greater.
- You will compensate us for claims by third parties that arise from your Inputs, or from your use of Outputs in breach of these terms.
For everyone
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude.
Suspending and closing accounts
- You can stop using Meshsmith at any time. Cancel any subscription, and email info@finterm.xyz if you want your account deleted.
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires us to, or to protect the service or other users. Where it is reasonable to do so, we will tell you first and give you a chance to fix the problem. If we close your account without good reason, we will refund any amount you have paid for the rest of your billing month.
- If we stop providing Meshsmith altogether, we will give you at least 30 days' notice so you can download your models. We will refund any amount you have paid for the period after the service ends.
Changes to these terms
We may update these terms, for example to reflect changes to the service or the law. We will email you at least 30 days before significant changes take effect. If you do not agree to them, you can cancel before then. If you keep using Meshsmith after that date, the new terms apply.
General
- We may transfer this agreement to another person or business. We will tell you if we do, and your rights will not be reduced. You may not transfer your rights without our written agreement.
- No one other than you and us has any rights under these terms.
- If a court decides that part of these terms is invalid, the rest still applies.
- If we do not enforce a right straight away, we can still enforce it later.
- These terms, together with the policies linked above, are the whole agreement between you and us about Meshsmith.
Governing law and disputes
These terms are governed by the law of England and Wales, and disputes will be decided by the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and you keep the protection of the mandatory laws of the place where you live.
